I just received a check from BMW NA for the repairs to my 00' 328Ci subframe. Talk about reducing the cost of ownership! It's too bad that it takes a lawsuit to get BMW to step up to the plate. (Not that they have admitted any responsibility.) Mark

How broad was the settlement? I have an M Roadster that I believe will eventually need repair...any info would be appreciated.

Quoting from the Court Documents:

"Class vehicles are BMW E46 Vehicles distributed by BMW NA in the United States. BMW E46 Vehicles consist of all 1999-2006 Model Year 3 Series vehicles and does not include the Z3 model vehicle (E36) or Z4 model vehicle (E85). ..."

Apparently only the E46 physical chassis design has been shown to have the problem.

Only the E46 vehicles are covered by the settlement.  There are plenty of people on the web with pictures of Z3s showing the same problem.  Perhaps the complaints from Z3 owners haven't reached the same level as those from E46 owners, so BMW continues to ignore the problem.  I would think E36 vehicles would be subject to the same problem as the Z3s, isn't the Z3 rear suspension very similar to the E36?  Probably a good question for TMS or Schneller.
